Hi Yes, it's the life of a video blogger again. Woke up this morning check my email. What do I get another copyright claim on my video in this time, but this time around they've shut down my video completely. It's blocked.
Let's have a look. Hi Eevblog sorry about my voice I Don't know what's going on due to a cop over and above my usual voice. Due to a copyright claim, your YouTube video has been blocked. This means that your video can no longer be played on YouTube Thanks for that Guilty until proven innocent Eevblog number 11 36 Banksy Artwork Shredder Video Part 2 claimed by Canal + Blur may contain copyright contact.
Copyright owners can choose to block YouTube videos that contain their cop content. Now this is the thing. Video creators including myself I haven't enabled this, but any video create especially large corporations on YouTube when they set up the YouTube channel have the option to turn on video Content ID so that every time you upload a YouTube video, then it the Alga algorithm automatically magically Maps Certain searches it and puts it all into the database so that anytime anyone else uploads a video, it gets checked against that magic database. I Don't know how they do it, it's so huge.
Let's just the logistics are doing this. The technical logistics are doing this is so huge I Don't understand how the able to do this but anyway yeah your content can be automatically matched against this database. If it matches then the claimant in this case can now. Plus they they claim that they own the copyright on that video.
They don't have to prove they own the copyright, they can just claim that they own the copyright and then they can either choose to block. In this case, block my video or they can choose to take my effort or still allow the video. But they get all the advertising revenue and this is not the first time this has actually happened to this particular video. It also happened when was this first in November the same video who got claimed.
The exact same video has now been claimed by two different parties. the Banksy Artwork Shredder claimed by Vali Arm Digital Proprietary Limited which is actually an Australian company. They claimed that they owned the copyright content, but I disputed that and and won that. but they didn't block my video.
They chose to just take my advertising revenue and they said apologies for the late response. We were under the impression that the creator on our network owned this content. When it was established that they didn't we release the claim immediately. Apologies.
Ok, fair enough, but you know they should have verified that the owner that the bird. because this is like a large company whom handled some like a management company who handles many different channels. you know they just assume that they own the copyright, etc. Anyway, they did apologize and they release the claim.
And no, they do not get the advertising revenue when a claim like this is put in and the video is not blocked, it's just like the claimant is claiming the advertising revenue for it. YouTube Actually hold that revenue until the dispute is finished and then when the dispute is finished, all the advertising revenue goes to in this case back to me who basically wins the case. So yeah, we've got the same again. And if you go in here, of course, audio-visual content match from 14 minutes to 1443 there. That's what they claim matches and let me play this. so if it doesn't come through properly, it may not. Anyway, you can play it yourself. Oh I never could.
Oh bloody hell stupid. it's my browser. Something's up with Chrome I Don't know what the deal is. Anyway, here we go.
Just use Opera browser quickly. let's have a look played. Match Here is the match. Sorry if you can't hear that, but it's basically 43 seconds of Me Adam commentary adding value, right? So this is clearly fair.
Use me talking over and commentating over our Banksy's original video. So they're claiming copyright, as did Valium over Banksy's video and it is Actually it's the video is actually comes from here from Banksy's own original channel. Banksy is the one that owns the copyright to this video. not Canal+ or Valium or anyone else or any other news agency that uses this.
And here's the problem. All these news channels and everything else they they use. Banksy's video. Our part of it or whatever.
don't add any value. A lot of them. The previous claim from Valley Arm simply uploaded Banksy's original video and then claimed copyright over it. Unbelievable.
So so what they do is they either upload the whole content that's not theirs and then because their channel is set for automatic Content ID Every video they upload, even if it's not their own work, goes into the copyright claim system and they claim copyright on it and the system just automatically claims copyright. It's completely not a So in this case. I don't like the YouTube feature because it doesn't tell. Okay, it tells me who the claiming is can our plus but it doesn't tell me where the original video is so I can't even view it.
So is that some news story with the video have Canal+ just re uploaded the video or whatever. Anyway, my video they have decided that are there. They don't want my ad revenue. they just want to block my video so make video is currently blocked.
You cannot watch it until I. File a dispute and you're damn right. I Will file a dispute because they do not own the comp content Banksy does and even in that case it is fair use because I'm adding commentary on top of it. It's a technical news analysis video.
I Like Unbelievable. So this is the crap you got to put up with. so who are can now? Plus well, are there some huge French premium? TV Channel launched in 1984. Who cares? They probably some huge conglomerate own a whole ton of stuff I Don't know. and if you go over their channel I assume that this is their channel they're talking at once again. I Don't know YouTube Don't tell me. They just say Canal+ could be any one of the companies just like Valium. When that valium claim came in, it wasn't Valium as channel who did it.
it was one of their because they're a management company was one of their channels that they were handling. so they handle the blanket copyright claim for all of the channels that they manage is one of those you know, like a multi-channel network thing. So yeah, and of course, and if you search Banksy on there you get zippity-doo-dah So yeah. I Have no idea where this claim is even coming from.
So just from a transparency point of view, this whole copyright claim process is. So let's go into file a dispute. Shall we? Here we go. I Believe this content claim is not valid because there's no option is because the original claimant doesn't own the copyright.
you know it's anyway. So I've got to go through the what Is that? The fair use? It's not. It's not my original content, so it does. Actually, my video does claim fair use.
legal requirements for fair use of fair dealings under the copyright law. Bingo! I don't have permission from Banksy the company? Yep, that'll do fair use. I am sure and you only get like a limited number characters to explain yourself to like you can't give a a full detail I Can't believe it and I can't remember how many a characters is, but it's not many. You can only put it like a sentence or two tops anyway.
so I'll fill in that and it should. Hopefully I should win the claim on this, but this is the this is the that video creators like me have to deal with. Like I don't get many. Imagine if you were doing news commentary all the time you're a channel who are doing that.
You get hit with this. You know, like I Hear about video bloggers? You get hit with this like all you know, daily or weekly or whatever. It's just unbelievable for companies to claim content and copyright on content they don't even own. Ridiculous.
Anyway, keep you updated and yeah, I'll put in the link to my original video down below and if it starts playing again and you know I've won the claim anyway. Unbelievable. Catch you next time.
No… They need to shut down the contentID and other abusive algorithms
They really need to have people review the claims BEFORE the claim is filed.
I've had to deal with this a number of times too. One video got claimed by a company for using certain music. I disputed the claim proving the music had fallen into public domain. They dropped the claim and within an hour (took over a week to close the dispute) another company claimed the same music. I disputed it again, literally copy & pasting the dispute from the first claim, and after about 5 days I got my video back. At which point it was claimed by the first company AGAIN. I was not as kind or professional from that point on, fighting claims on the video 3 more times after that. Youtube's copyright system is just freaking ridiculous.
What really annoys me about this is that if your video is commenting on current affairs, and therefore has a limited time window of relevance, blocking it may massively reduce the video's view count and therefore ad revenue.
If the claimant chooses to block a video, then they should be forced to compensate for lost revenue for monetised videos (based on a projected ad revenue calculation basis) for false claims.
YouTube (Google) :
Shoot (to kill) first, then never ask questions!
Copyright law is so ridiculous, it's not even about protecting creators it's about allowing megacorps to profit off the creations of others. These big companies can just use something someone else made and then claim they own it. It's bullshit. The concept of fair use also does not really exist anymore, you're not even allowed to use a clip of something, or to use a song as background music even if you give credit. The whole system is rigged yet again to cater to megacorps. Youtube is partially at fault for making the process a nightmare but they're kinda obligated because of how ridiculous the laws are. Someone needs to start a YT competitor and host it in a better country.
There's a new thing going around where just MENTIONING the name of a copyrighted song (Bohemian Rapsody) is enough to get your video flagged. It's completely insane.
i would talk to a lawyer, and get him to count the problem up..keep him in the loop..
Should be taken to court. This is theft. False copyrighting content that isn’t yours.
There's should be 3 strike system for false fair use claimers:
1. Suspended for claiming over some period
2. All claims is retracted
3. You cannot claim it anymore
Btw it's just unfair that some stuff on content id repo is either private or unlisted! They don't tell where is original one!
You need to team up with all the political guys getting shut down. It's not about content. You're not a mega corperation. It's also not about context
water mark your vids so it becomes unusable too others ! maybe stop them stealing content?
C ANAL
i managed to view the video so you must've won ! 😊
Will Canal Plus pay for the lost revenue on the video?
I wonder how many thousands of people don't fight copyright, ip and patent claims and just pay up or settle out of court for something that shouldn't ever get to court anyway just because they are threatened/get scared.
There must be a lot of troll lawyers and companies making bogus claims and being handed money or taking over money from advertising revenue, also blocking everybody's video clips/public domain redistribution means that anyone looking for that video clip will be diverted to the bogus channel and the advertising visitor counter for them will go up… I don't know just exactly how valuable it is for people claiming ownership.
I do not think Banksy would be very happy…
I just got gigged by a content troll by the name of Studio71_2_1 and it looks like the automated content ID fingerprinting YT does is the reason. I uploaded my video where I review the BenQ 32 Inch 4K monitor more than 2.5 years ago and had something over 30K views before Studio71_2_1 made the claim. They allowed me to continue to offer the video but they wanted all the money it generates. I wish I'd seen this video before I deleted my video as I'd have filed a dispute. My review video included a few minute clip using the Unigine Valley Benchmark to show of the monitor in 4K and it was this section of my video that was flagged for content matching. The thing is, the claimant doesn't own Valley Benchmark and I'd guess the channel, jacksepticeye, that issued the complaint probably has a video that includes some of the same Valley Benchmark clip so the content ID thing sees my video as matching there's — I bet there video was published more recently, but as Dave Jones indicates, the YT complaint system doesn't include the name of the video that my video is supposed to have infringed so I have no way to see what they have.
THIS is why we need BREXIT!
I WILL KICK THEIR ARSE FOR DAVE
And there's crazyrussianhacker who DMCA abuses….
Hopefully, Canal + will end up with a big Banksy mural showing them screwing over the little guy all over their HQ!
good you got them to sort it out as video plays now.
I had it happen to me on the Gold Coast in Southport in Chinatown near the tram station when there was a stage with dancers and the music was centuries old that I found out when I looked it up. This happened a few years ago. I got one strike on it that day.
It sounds like scammers out there.
